These Terms and Conditions govern the agreement between Jineus Covers (hereafter referred to as “Designer”) and the client (hereafter referred to as “Client”).

1. GENERAL

The following terms and conditions apply to all projects undertaken by Jineus Covers unless otherwise agreed in writing.

2. COPYRIGHT – OWNERSHIP AND RIGHT OF USE

2.1. Copyright and ownership remain with the Designer. Upon full payment, the Client obtains the Right of Use for the final artwork (in formats such as PDF, PNG, JPEG) for eBook and/or print usage and associated promotional materials.
2.2. This Right of Use is granted indefinitely as long as the work is used under the agreed-upon terms and for its intended purpose.
2.3. The Designer may use the work in their portfolio and for promotional purposes, with reasonable time granted to the Client for a public reveal.
2.4. The Designer retains all rights to preliminary designs and unused concepts, which may be reused for other clients or as premade artwork.

3. COVER FILE EDITING BY CLIENT

3.1. The Client may not alter the final design beyond resizing for print or digital display. All other edits must be requested through the Designer, and additional fees may apply.
3.2. The Client may not reuse parts of the design for unrelated projects or hire another designer to alter it, unless written consent is granted. Drafts may only be shared privately for feedback, not publicly displayed.

4. INFORMATION ON STOCK IMAGES

The Client agrees to the terms of any image license acquired by the Designer (e.g., from Depositphotos or similar). Usage is covered under a Standard License, which includes up to 500,000 print copies and unlimited digital use. The Client is responsible for additional licensing if exceeding this limit. The Designer is not liable for misuse of licensed images by the Client.

5. PUBLISHING RIGHTS

5.1. If the Client provides images or materials, they confirm they own or have secured the proper rights. The Designer is not responsible for any legal disputes arising from provided content.
5.2. The Designer may request proof of image rights and reserves the right to decline using any material that may pose a legal or ethical concern.

6. SCHEDULING

Project timelines will be agreed upon in advance. The Client must allow reasonable time for completion. The Designer reserves the right to decline or reschedule projects based on availability.

7. ATTRIBUTION

The Designer requires credit for the cover design, which should appear in the book (e.g., on the back cover or copyright page):

8. PRICES AND PAYMENT

8.1. A booking fee is required to reserve a custom cover slot. A 50% deposit is due prior to the project start or a full payment depending on the agreed terms.
8.2. If the project is cancelled by the Client, the deposit will serve as a cancellation fee. This does not apply to rescheduled projects with proper notice.
8.3. Once the draft is approved, the final balance is due. Payment is accepted via PayPal.
8.4. Unlimited of revisions are included if its minor; further complex revisions may incur additional charges..
8.5. The Designer may adjust pricing on a case-by-case basis, with all fees clearly communicated before starting.

9. PUBLISHING DATA – RAW FILES

9.1. Source PSD files are not included due to copyright and stock license limitations.
9.2. A version with flattened artwork and separated text/character layers can be requested for an additional fee.

10. LIABILITY AND WARRANTY

10.1. The Designer is only liable for damage caused intentionally or by gross negligence.
10.2. It is the Client’s responsibility to check for any errors or defects before publication. A printed proof is strongly advised.
10.3. Once the design is approved, the Designer is no longer responsible for issues related to print or text accuracy.
10.4. All working files will be archived and stored by the Designer for up to two (2) years and can be restored free of charge if lost during this time.

11. CONFIDENTIALITY

11.1. All client-provided data is confidential and used solely for communication and project completion. No data or materials will be shared with third parties.
11.2. The Designer may use the Client’s name and book title for promotional purposes, such as portfolio features.

12. FORCE MAJEURE

Neither party shall be liable for delays or failure to perform due to events beyond their control (e.g., natural disasters, war, or system outages). The affected party must notify the other immediately and take reasonable steps to minimize delays.

13. CONCLUSION

By proceeding with services, the Client agrees to the terms outlined in this Agreement with Jineus Covers.
